members have any interest yet both NATO and the UN committed significant
resources and human capital towards this conflict.

of this conflict won’t be accepted in the international community unless they
are prosecuted for their crimes. Even though they aren’t actual prisoners
behind bars they are virtual prisoners as they cannot live regular lives or
roam freely across borders, those people are marginalized not human right
violations. Throughout the years and the growing conflicts the principle of
non-interference with domestic jurisdiction of states is no longer used as a
barrier behind which human rights are violated with impunity.

Liberalists refuse to accept that due to divers
situations the UN hasn’t been able to prevent acts of cruelty and brutality as
an argument, legal or moral against the right actions especially when peace and
human lives are threatened. Through the Yugoslavia tribunal it was demonstrated
that even if the international community cannot make parties comply with their
international commitments they confront those who commit these genocides and
war crimes.

 

Liberalists highlight that human rights are
amongst the principles that challenge the priority of sovereignty and the
national interest of states. Nonetheless, they do admit that sovereignty and
political demands are an obstacle when promoting protection, peace and human
rights. The major deciding factor as to whether international criminal courts
will become important is the hegemonic leadership in politics. As per usual the
United states refuses hegemonic leadership. Liberal institutionalists
acknowledge that hegemonic leadership is a necessary for the creation of
international organizations, but the hegemon is not going to support every
institution-building effort.
